CSS Solutions Platform Sdn Bhd (hereinafter referred as “we” or “us” or “CSS” “Drink2points” “our”) are committed to safeguarding your privacy and ensuring that your personal data is protected. We shall ensure that our policies and practices in relation to personal data comply with the requirements of the Personal Data Protection Act 2010 (“the Act”) under the laws of Malaysia. This Privacy Policy applies to the Drinks2points mobile application (“the Mobile App”) and to the personal data collected about you by CSS Solutions Platform Sdn Bhd. By using the Mobile App, you shall be deemed to have agreed to the terms and conditions in relation to this Privacy Policy (“the Terms”). If you do not agree to the Terms or to our Privacy Policy as contained herein, please do not access the Mobile App or use the Services (defined below). A. Terms of Service
By accessing the Mobile App or using the services offered by CSS Solutions Platform Sdn Bhd (“Services”), you acknowledge and agree to be bound by the Terms, all applicable laws and regulations and agree that you shall be responsible to comply with any local law applicable to you. If you do not agree with any of the Terms, please cease or refrain from from using or accessing the Mobile App. The materials contained in the Mobile Appare protected by applicable copyright and trademark laws.
B. License To Use
Permission is granted to you to temporarily download one copy of the materials (information or software) on the Mobile App for personal, non-commercial transitory viewing or usage only. This is the grant of a licence and not a transfer of title and under this licence, you may not: modify or copy the materials; use the materials for any commercial purpose or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained in the Mobile App; remove any copyright or other proprietary notations from the materials or to transfer the materials to another person or “mirror” the materials on any other server or platform. This licence shall be automatically terminated if you violate any of these restrictions and the license may be terminated by CSS at any time. Upon terminating your viewing or use of these materials or upon the termination of this licence, you must destroy any downloaded material which are in your possession whether in electronic or printed format.
C. Disclaimer
The materials on the Mobile App are provided on an ‘as is’ basis. CSS makes no warranty whatsoever , whether expressor implied, and hereby disclaims and negates all warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement of intellectual property or other violation of rights. Further, CSS does not warrant nor makes any representation concerning the accuracy, likely results or reliability of the use of the materials on the Mobile App or otherwise in respect of any material made available on the Mobile App or on any site linked to the Mobile App.
D. Limitations
CSS shall not be in any way held liable for any loss or damage (including, without limitation, damages for loss of data or profit or due to business interruption) arising out of the use or inability to use any of the material on the Mobile Appl, notwithstanding that CSS or its authorised representative may have been notified orally or in writing of the possibility of such damage.
E. Accuracy of materials
The materials appearing on the Mobile App could include technical, typographical, or photographic errors. CSS does not warrant that any of the materials on its interface are accurate, complete or current. CSS may make changes to the materials contained on its interface at any time without notice. However, CSS does not make any commitment to update the materials.
F. Links
CSS has not reviewed all the sites linked to the Mobile App and is not responsible for the contents of any such linked site. The inclusion of any link does not imply or constitute endorsement by CSS of such site. The use of any such linked websites shall be at your own risk.
G. Modifications
CSS may revise the Terms in respect of the Mobile App at any time without notice. By using the Mobile App, you are agreeing to be bound by the Terms.
H. Governing Law
The Terms and the use of the Mobile App are governed by and construed in accordance with the laws of Malaysia and you irrevocably submit to the exclusive jurisdiction of the courts in the State or location at which you reside.
